These Terms of Use ("Terms") govern your use of the SkyPath VPN application ("App") and the website at skypath.cloud ("Website"), provided by SkyPath ("we", "us", or "our"). By downloading, installing, or using SkyPath, you agree to these Terms. If you do not agree, please do not use our services.

1. Description of Service

SkyPath provides a virtual private network (VPN) service that encrypts your internet connection and routes it through our servers. The service is designed to enhance your privacy, security, and ability to access content while browsing the internet.

SkyPath is provided as a free service. We may introduce optional paid features in the future, which will be clearly communicated before any charges apply.

2. Eligibility

You must be at least 13 years old to use SkyPath. If you are under 18, you should review these Terms with a parent or guardian. By using the App, you represent that you meet these age requirements.

3. Acceptable Use

SkyPath is intended for lawful, personal use. When using our service, you agree not to:

• Use SkyPath for any illegal activity, including but not limited to distributing malware, engaging in fraud, or violating any applicable laws in your jurisdiction.
• Attempt to gain unauthorized access to our servers, other users' data, or any systems connected to our network.
• Distribute spam, viruses, or other harmful content through our service.
• Use SkyPath to harass, threaten, or harm others.
• Interfere with or disrupt the operation of our service or infrastructure.
• Use SkyPath for commercial purposes without our prior written consent (e.g. reselling VPN access).
• Reverse-engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.
• Use automated tools (bots, scrapers) to abuse the service or create excessive load on our servers.

We reserve the right to suspend or terminate access for users who violate these terms.

4. No Guarantee of Specific Outcomes

While SkyPath enhances your privacy and may help you access restricted content, we do not guarantee:

• That the service will bypass all content restrictions in all regions at all times.
• Complete anonymity — a VPN is one layer of privacy, not a guarantee of total invisibility.
• Uninterrupted or error-free service. Connectivity may be affected by network conditions, server load, or maintenance.

5. Intellectual Property

All content, code, graphics, logos, and trademarks associated with SkyPath are owned by us or our licensors. You may not:

• Copy, modify, or distribute the App or any part of it, except as permitted by these Terms.
• Use the SkyPath name, logo, or branding without our prior written permission.
• Remove or alter any proprietary notices within the App.

The App is licensed to you, not sold. Your license is non-exclusive, non-transferable, and revocable.

6. Third-Party Services

SkyPath may use third-party services (such as Firebase for analytics and crash reporting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

7. Disclaimer of Warranties

SkyPath is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The service will meet your specific requirements.
• The service will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the service will be accurate or reliable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SkyPath and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, revenue, or profits.
• Service interruptions or inability to use the service.
• Unauthorized access to your transmissions or data.
• Any conduct of third parties related to the service.

Our total liability for any claims arising from or relating to these Terms or your use of SkyPath shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or ten US dollars ($10), whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless SkyPath, its affiliates, and its personnel from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the service.
• Your violation of these Terms.
• Your violation of any law or the rights of a third party.

10. Termination

You may stop using SkyPath at any time by uninstalling the App.

We may suspend or terminate your access to the service at any time, with or without notice, if we reasonably believe you have violated these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes:

• We will update the "Last updated" date at the top of this page.
• We will notify users through the App or Website when practical.

Your continued use of SkyPath after changes are posted constitutes your acceptance of the revised Terms. If you do not agree with the changes, please stop using the service.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of SkyPath shall be resolved in the appropriate courts.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SkyPath regarding the use of our service. They supersede any prior agreements or understandings.
